The Information Clause to be applied in communication where VM.PL Sp. z o.o. is a Party or during which VM.PL Sp. z o.o. collects and processes data for the purpose of entering into and executing an agreement.

Collecting and processing personal data

Dear All,

We kindly inform you that VM.​PL Spółka z ogra­ni­czo­ną od­po­wie­dzial­no­ścią (limited liability company) with its registered office in Wrocław, ul. Ko­ściusz­ki 82, 50-441 Wro­cław (further referred to as VM.​PL) processes information from various public and generally available sources (including the Internet), creating databases in this way. Among the information there may be data with a nature of personal data in the meaning of the Regulation of the European Parliament and the Council 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (further referred to as the General Regulation or the GDPR).

Therefore, in compliance with the applicable provisions concerning personal data protection, including the General Regulation, to ensure proper personal data protection, the data subject should be provided with information concerning the processing of their personal data specified in art. 13 or 14 of the GDPR – depending on whether it was obtained directly from the data subject or from other sources.

Therefore, we would like to inform you that:

1. The Administrator of your personal data (further referred to as the Administrator) is VM.​PL spół­ka z ogra­ni­czo­ną od­po­wie­dzial­no­ścią, with its registered office in Wrocław, ul. T. Ko­ściusz­ki 82, 50-441 Wro­cław, entered into the Register of Entrepreneurs kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Economic Division of the National Court Register under no. KRS 0000201477, NIP (Tax Identification Number): 8951811558, REGON (Polish Business Registry Number): 932985224, with share capital in the amount of 116,400 PLN. 2. Your personal data is processed based on art. 6 sec. 1 letter f of the GDPR, i.e. based on the necessity to process data for purposes arising from legally justified interests implemented by the Administrator or a third party. Legally justified interests implemented by the Company involve offering services in terms of creating and developing computer software to customers, provided by the Administrator which most of all contributes to satisfaction of their needs. Processing of personal data for the needs of the above-mentioned services is included in the scope of business operations of the Company revealed in the Register of Entrepreneurs of the National Court Register. It is necessary for the Company to create and provide such services to its customers.

3. Your personal data is processed to provide customers or potential customers of the Company with complex information about services and products offered by the Company as well as for statistical purposes.

4. The Administrator processes your personal data in the scope it is made available by publicly available sources, applying the principle of minimalism in this scope specified in art. 5 sec. 1 letter c of the GDPR.

5. The Company shall not process special categories of personal data or personal data concerning convictions and violations of law or related security measures.

6. The Company shall not transfer your personal data to other subjects.

7. The Company shall not transfer your personal data to recipients in third parties, i.e. outside the European Economic Area or to international organizations.

8. Your personal data shall be processed by VM.PL for a period necessary for the implementation of legally justified interests of the Company referred to in item 2 above.

9. In relation to the processing of your personal data, you shall have the right to:

  • request access to your personal data from the Administrator,
  • request rectification of your personal data from the Administrator,
  • request deletion of your personal data from the Administrator,
  • request limitation of the processing of your personal data from the Administrator,
  • object against the processing of your personal data,
  • transfer your personal data,
  • file a complaint to a supervisory body.

11. Your personal data has been obtained from publicly available sources, i.e. among others from the Register of Entrepreneurs of the National Court Register (KRS), Central Register and Information on Economic Activity (CEIDG), Central Statistical Office (GUS), social networks and other websites.

12. As the Data Administrator the Company makes every effort to ensure adequate data security measures in accordance with applicable regulations and the security policy approved by the Company by applying relevant technical and organizational security measures in reference to personal data protection before its accidental or intentional destruction, loss, change, unauthorized use, disclosure or sharing.

13. Your personal data is processes in an automated and manual manner, pursuant to the methods and procedures related to the purposes of the processing referred to in item 3 above.

Our website https://vm.pl uses cookies. These are small text files sent by the web server to the user's browser and stored by this software. When the browser reconnects with the site, the website recognises the type of device the user connects with. The parameters allow to read information contained in them only by the server that created them. Therefore, cookies make it easier to use previously visited websites.

The information collected relates to the IP address, type of the browser used, language, type of the operating system, Internet service provider, information about time and date, location and information sent to the website via the contact form.

The collected data is used to monitor and check how the users use our websites, and to improve the functioning of the website, ensuring more effective and seamless navigation. User information is monitored with the use of the tools described below.

  • cookies used to ensure security, e.g.: to detect fraud in the authentication by the website,

Additional personal data, such as an e-mail address, is collected only in places where the consent is expressly given by completing the form by the user. The above data is kept and used only when necessary to perform the given function.

Currently, the following plugins are used on the entire VM.PL website to collect and process your data based on cookies:

  • Facebook Pixel
  • Hotjar

Use of Google Analytics

Google Analytics serves to analyse the use of the website. The data obtained is used to optimise our website and advertisements.

Google Analytics is a web analysis service operated and provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Google processes data on the use of the website on our behalf and undertakes contractually to take actions to ensure confidentiality of the data processed.

When visiting the website, the following information will be recorded:

  • Names of sites visited
  • Your actions on sites (e.g. clicks, scrolling and duration of stay)
  • Your approximate location (country and city)
  • Your IP address (in short form so that a unique assignment is not possible)
  • Technical information such as a browser, the Internet provider, terminal and screen resolution
  • Source of your visit (i.e. via which website or advertising materials the user visited our site)
  • The above data is sent to the Google server in the USA. Google complies with the data protection provisions concluded in the EU-US privacy agreement.

Google Analytics stores cookies in a web browser for a period of two years starting from the date of your last visit. Cookies contain a randomly generated user ID that will allow to recognise the user during future visits to the site.

Your recorded data is stored together with the randomly generated user ID that allows for evaluation of anonymous user profiles. Such user data is automatically deleted after 14 months. Other data remains stored in an aggregated form for an indefinite period.

If you do not agree to the collection and processing of your data described above, you can prevent this by one-off installation of the browser add-on to disable Google Analytics.

Use of Facebook Pixel

We install a user behaviour monitoring pixel on our website, provided by

Facebook Inc. 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”)

When you visit our site, your data is collected by us by means of cookies provided by Facebook. This data is then sent to Facebook. Users' behaviour can be monitored when they are redirected to the advertiser's site after clicking on an advertisement on Facebook. This type of monitoring is performed for statistical and market research purposes. It also helps in optimising further advertising activities.

The stored data is anonymous, it does not provide any information on the identity of users. However, it is collected and processed by Facebook, therefore it is possible to connect it to the respective user profile, and Facebook can use this information for its own advertising purposes, in accordance with the rules of using Facebook data:https://www.facebook.com/about/privacy/. You can change the display settings of Facebook advertisements and its partner sites. Separate cookies may be stored on your computer for these purposes.

Only users who are at least 13 years of age may agree to use the user behaviour monitoring pixel.

Use of Hotjar

Hotjar is a tool used to analyse and visually represent user behaviour on the Internet. We use the so-called heat maps, Hotjar surveys to improve the comfort of using our website. Hotjar collects real-time responses from any device. The data is stored in Ireland for 365 days starting from the date of the data capture.
